Licence to Fish for Shellfish in a Contaminated Area Application Information

Licence Category:

Licenses to fish for shellfish in contaminated areas are issued under authority of the Management of Contaminated Fisheries Regulations for both vacant crown foreshore and aquaculture tenure sites. Shellfish fisheries in contaminated areas have been licensed by Fisheries and Oceans Canada since the 1990’s, in accordance with policies set out in the Canadian Shellfish Sanitation Program (CSSP). All licence applications are reviewed by CSSP agencies and the Province of BC on a location by location basis. All harvesters (Master Harvesters and Harvesters) must be named on the licence as a regulatory requirement.

Clam Depuration – Tenures:

Licenses may be issued to owners of registered depuration facilities to harvest clams from aquaculture tenure sites in marginally contaminated areas for depuration. The legal tenure holder of the area under tenure, if different from a depuration facility must jointly apply with the depuration facility. A Fishers Registration Card (FRC) is not required for fish harvesters on tenures. The species must be included as a species of culture under a valid Aquaculture Licence (AQSF licence).

Clam Depuration – Vacant Crown Foreshore:

Licences may be issued to owners of registered depuration facilities to harvest clams from vacant crown foreshore with an approved beach allocation. Allocation, stock assessment, data, licence condition compliance and other requirements must be met. A valid Fishers Registration Card (FRC) must be obtained by every fish harvester named on the licence. Where a Joint Venture Agreement exists between a First Nation and a depuration facility for harvest in areas fronting or immediately adjacent to Indian Reserves, the First Nation must jointly apply. An FRC is not required at this time for fish harvesters named on a Joint Venture agreement licence.

Oyster Relay:

Licenses may be issued to individuals or companies. Oysters may be harvested in closed marginally contaminated areas for relay to tenures in open areas. In order to harvest oysters for relay either FROM or TO an aquaculture tenure, the tenure must be held by the licence applicant or a written notice of approval from the tenure holder is required with the application. BC Ministry of Natural Resource Operations reviews all applications involving aquaculture tenures to confirm ownership of tenures. The species must be included as a species of culture under a valid Aquaculture Licence (AQSF licence).

Licence Fees:

$100.00 for the licence, plus $20.00 for each harvester (Master Harvesters and Harvesters) named on the licence. All cheques or money orders are payable to the Receiver General for Canada. Contact the Pacific Fishery Licence Unit for other fee payment options.

All applications to fish for shellfish for food from marginally contaminated areas must include:

  • A decontamination plan approved by the Canadian Food Inspection Agency (CFIA).
  • The full legal names and dates of birth of all harvesters (Master Harvesters and Harvesters) involved in fishing on the site.
  • Clear detailed maps /charts showing sites of harvest (and relay destination if applicable).
  • Licence fees

Approval Process:

Completed application packages are referred to the agencies listed below for approval, special conditions or advice. This process for complete applications takes a minimum of 10 working days. Licence issue may take up to 20 working days from the date of application receipt. The agencies are:

  • Environment Canada assesses the shellfish growing water quality and status in the harvest area
  • BC Ministry of Natural Resource Operations assesses land status (tenure or vacant crown foreshore)
  • Canadian Food Inspection Agency reviews and must approve the decontamination plan or protocols.
  • Fisheries and Oceans Canada, Fishery Managers review for stock conservation, management and control of fishing operations and Aquaculture Management Division reviews for compliance with aquaculture management plans.

Licence Condition Amendments

Licence condition amendments must be requested following the issuance of a licence to authorize the specific fishing areas, species and the total allowable catch where applicable. Licence condition amendments may be requested from the Fishery Manger in Nanaimo.
